1. Acceptance of Terms

By accessing or using ImmiMedical ("the Service"), operated by NTX Medical ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. Your continued use of the Service constitutes acceptance of any updates or modifications to these terms.

2. Description of Service

ImmiMedical is a web-based platform designed to streamline the management of USCIS Form I-693 immigration medical examinations. The Service provides workflow tools for civil surgeons and their practices, including applicant intake, document preparation, examination tracking, appointment scheduling, and patient billing. Applicants use it to complete their part of the form, manage their household’s exams, and download their completed exam packet.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep your account information up to date. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Submit false, misleading, or fraudulent information through the Service
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to transmit any malicious code, viruses, or harmful content

5. Civil Surgeon Designation

This section applies to every medical practice that uses the Service ("Practice") and to each person the Practice names as a civil surgeon.

• The Practice is responsible for designation. The Practice represents and warrants that every person it names as a civil surgeon on the Service, including a practice administrator who certifies exams, is and remains currently designated by U.S. Citizenship and Immigration Services (USCIS) as a civil surgeon, and that each name and Civil Surgeon ID entered for them is accurate.
• Stop when a designation ends.If a civil surgeon's designation is revoked, suspended, expires or otherwise ends, the Practice and that civil surgeon must immediately stop using the Service to complete or certify Form I-693 for that person, remove them as a civil surgeon in the Service, and tell us at the address in section 13.
• We do not verify designations.NTX Medical does not verify, certify or guarantee any civil surgeon's USCIS designation, Civil Surgeon ID or qualifications, and does not monitor them over time. We may, at our sole discretion, look at public USCIS information or documents a Practice gives us, but any such review is for our own purposes only. It is not a verification, a representation to anyone, or a substitute for the Practice's own obligations, and we are not responsible for errors in USCIS or other public sources.
• Indemnity. The Practice will defend, indemnify and hold harmless NTX Medical from any claim, loss, penalty or expense arising from a person certifying Form I-693 through the Service without a current USCIS designation, or from inaccurate civil surgeon information entered by or for the Practice.
• We may suspend a Practice or a civil surgeon's access to the Service if we have reason to believe a designation has ended.

6. Medical Disclaimer

ImmiMedical is a workflow and document management tool. It is not a medical provider, and it does not provide medical advice, diagnosis, or treatment. All medical decisions related to I-693 immigration medical examinations are made solely by licensed civil surgeons. NTX Medical assumes no responsibility for clinical outcomes or medical determinations made by healthcare providers using the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. The Service is designed to comply with applicable data protection regulations, including HIPAA where applicable. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Intellectual Property

The Service, including its design, code, features, and documentation, is the property of NTX Medical and is protected by intellectual property laws. You retain ownership of all data you submit through the Service. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, NTX Medical shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising out of your use of the Service. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

Either party may terminate this agreement at any time. We reserve the right to suspend or terminate your access to the Service if you violate these terms. Upon termination, your right to use the Service will cease immediately. Exam records are kept for the period the law requires, as described in our Privacy Policy. Applicants can request a copy of their records from their practice.

11. Changes to Terms

We may update these Terms of Service from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in McKinney, Texas.
